Human rights organisations are preparing to take legal action in the UK against the British government and the EU for their inaction to minimize attacks, which the Palestinians are experiencing under the Israeli occupation, which is considered a breach of International Law and both the EU and British laws in general. In a significant move, which has important political and legal implications, the British Solicitors firm Hickman and Rose wrote to the EU Commissioner Jose Manuel Baroso and the British Foreign Minister Jack Straw challenging them to produce evidence for any action that the EU or the British government had taken to minimize the attacks on human rights of the Palestinians who live under Israeli occupation. The move by the solicitors firm has been done upon request from a group of entities among them the two organizations "War On Want", a large NGO which aims globally to fight poverty and "Dove and Dolphin", as well as other parties who feel that they are somehow effected by acts of Israeli aggression; among them some British citizens and others from different nationalities. The letters state that one year after the ruling of the International Court of Justice (ICJ) in The Hague, Israel’s Wall of Separation is illegal, "the EU and UK have failed to take the action required of them under the Geneva Conventions to ensure Israeli compliance with international humanitarian law". The letters pointed out that the UN Special Rapporteurs have called upon the EU to suspend the EU-Israel Association Agreement, under which Israeli exports enjoy preferential access to EU markets, on human rights grounds. The solicitors asked Baroso and Straw to provide any documents or letters that the EU or British government had sent to the Israeli government, including any minutes of meetings with the Israelis or even internal memorandums, which may have dealt with the separation wall after the announcement of the ICJ ruling in July 2004. The solicitors letter to the British government is based on the Freedom of Information Act, upon which the government is obliged to release the required papers and documents. Speaking to "Al Rai Al Am" the spokesman of "War on Want" Nick Dearden said that both letters of the solicitors to Baroso and Straw are "first step for litigation against the EU and the British government over inaction to take any necessary steps to punish Israel because of its aggression over Palestinian human rights". In the letter to Baroso the solicitors referred to the declaration made by the EU general assembly, regarding peace in the Middle East, its strategic importance to the world and the Mediterranean basin and the importance to adhere to contents of the "Road Map" and it's implementation. It also called upon the Israeli government to stop any settlement activities in Palestinian lands, including the building of houses, infra structures for settlements, by passing roads, the seizure of financial support and encouragement to settlers and the dismantling of illegal settlements, which are an obstacle for peace. In this declaration the EU expressed its worries about Israel's continuation in building the separating wall contrary to International Law. The solicitors said that their clients gathered all documents in relation to the steps, during the previous year ,which the EU and the British government took in this regard, pointing out that they did not find among these documents any evidence that both entities took any action to stop or minimize the Israeli breaches of International laws and conventions regarding human rights.
